In implementing Article 15 of the Copyright Directive, which introduces reproduction and making available to the public rights for publishers, the Italian legislator has mandated AGCOM to establish the reference criteria for determining the fair compensation owed by information society service providers for the online use of press publications. The Authority intervenes in determining fair compensation with the aim of bridging the so-called value gap, while safeguarding users’ access to information and fully respecting the parties’ negotiating freedom.
