Use of Algorithms and Artificial Intelligence in the Life Cycle of Public Contracts

This part of the contribution analyses Article 30 of the 2023 Public Contracts Code, which establishes a regulatory framework for automated decision-making in public procurement focused on “classical” algorithms. It addresses key challenges including transparency, human oversight, technical competence, and administrative liability, while highlighting tensions between national standards and evolving EU regulations. The analysis underscores the difficulty of balancing technological innovation with legal accountability and the rule of law in digital administration.
