This work examines the forms of computer documents, starting from the classification of digital signatures and, therefore, the simple electronic signature, the advanced electronic signature, the qualified electronic signature, the digital signature and, finally, the authenticated electronic signature as defined pursuant to Legislative Decree No. 82 of 7 March 2005, the Digital Administration Code and, for brevity, CAD, which is the new legislative text of reference on computer documents and digital signatures. The examination of the forms of digital contracts then continues with the public digital deed drawn up by the Notary Public and addresses the issues relating to the public official’s obligation to ascertain the validity of the digital signature certificates and the filing and preservation obligations of the public digital document on the part of the aforementioned professional.
