The International Court of Justice (ICJ, The Hague), on request of the General Assembly of the United Nations, delivered an advisory opinion on “Obligations of States in respect of Climate Change” on July 23, 2025. It is a milestone in global awareness-raising, ten years after the Paris Agreement of 2015 (see 1.4.2 ). The Court highlights “the customary duty to prevent significant harm to the environment”. This duty requires States to “use all the means at [their] disposal in order to avoid activities which take place in [their] territory (…), causing significant damage to the environment of another State”, i.e. transboundary environmental harm, especially by anthropogenic emissions of greenhouse gases (GHG, see 1.4.2 ).
