The International Negotiation Process for the Establishment of the New Legal Regime of the Caspian Sea

The case of establishing the modern regime of international governance of the Caspian Sea, due to its complexity and the new issues of an exceptional and specific nature that it raises concerning fundamental developments in the context, involves the complete revision of the regime. It is about establishing a new, completely separate legal regime that has no analogues in the world. The Chapter presents the main elements and time frame of the formation of the negotiation process with its main axes when applying the model of International Creative Negotiation, as summarised in the first of its kind Chronodiagram of the Negotiation Process (Table 6.1), where Phases, Sub-phases, Stages and Substages are distinguished. After a complex irregular process characterised as the Prenegotiation phase and the Premature Constitutive Negotiation Sub-phase before 2000, the negotiation process developed into the Constitutive Negotiation Phase with a comprehensive negotiation mechanism and a satisfactory level of coherence and cooperation among the Parties. From this point, the process is analysed per period between the Summits (preparation, discussion, results) with intermediate Meetings of the PAHWG and Councils of Foreign Ministers. A comprehensive interdisciplinary approach to the study of the problems of the Caspian region makes it possible to define a new direction for regional and international studies of the Caspian region.
