UK Spoliation Advisory Panel

There are different mechanisms to resolve disputes regarding cultural property. Some of these mechanisms have quasi-judicial character. Following the Washington Conference on Holocaust-Era Assets held in 1998, some States established quasi-judicial commissions or panels in order to find the location and return of cultural property seized during the Nazi era. One of these commissions is the UK Spoliation Advisory Panel. The success of the Spoliation Advisory Panel in the return of cultural assets is a good example of best practice for other countries. This study looks at how and why the Spoliation Advisory Panel was established and provides information on its duties. It also considers the UK Holocaust (Return of Cultural Objects) Act 2009 which allows the Secretary of State for Culture, Media and Sport to designate a panel to consider claims and allows national museums to return cultural objects where this follows a recommendation by the Panel and Ministers agree. Finally, the Spoliation Advisory Panel review procedure will be examined and a list of its decisions included with this paper.
