This chapter analyzes the potential of the ecological footprint concept as a decision-making tool in the legal field, especially in climate litigation. The first section presents the narrative with which modern law founded the treatment of the environmental issue and how it has evolved, mapping the contemporary approaches that law has offered to these problems. The second section (a) presents the idea of ecological footprint, its discursive and legal potential, (b) analyzes how the concept of ecological footprint can be translated within the legal field and (c) what its potential role may be in relation to administrative decisions (c.1.), legislative and regulatory (c.2.) and finally in relation to judicial decisions (c.3.). Finally, possible implementations of the ecological footprint in relation to the proof of damage and the purposes of its quantification in climate matters are pointed out.
