Vietnam’s Evolving Framework for FDI Policy and Legislation

This chapter provides a detailed exploration of Vietnam’s policy and legislative framework regarding investment. It begins with a retrospective examination of the economic development strategies and FDI attraction policies that Vietnam has implemented since the country started its economic liberalisation. Following this overview, the chapter analyses the Vietnamese government’s perspective on foreign investment, offering a comprehensive discussion of the policies created to attract FDI. The practical application of these investment attraction policies is reflected in Vietnam’s complex system of investment legislation. The chapter also traces the evolution of Vietnam’s investment legislation, highlighting its progress as it integrated into the regional and global economic landscape. This review emphasises the proactive approach of the Vietnamese government and its steadfast commitment to creating an enabling environment for foreign investment. It is noteworthy that the Vietnamese government has demonstrated an enhanced ability to formulate effective policies and manage associated issues over time. Ultimately, the analysis concludes that Vietnam’s investment legal framework has continuously evolved to align with international investment practices’ changing requirements and norms. The growing incorporation of environmental protection measures into investment legislation is particularly significant as it reflects Vietnam’s dedication to harmonising its legal framework with contemporary global standards in international investment.
