In this chapter, some ethical tensions between children’s right to protection and right to participation are discussed, based on the Swedish context. Drawing on research and legal debates, some examples from legal reforms and procedures for identifying children at risk of harm due to violence in social services and health care are examined and discussed from a critical child rights perspective. The central focus is on exploring possible ethical dilemmas. Since children’s views are central for detecting violence, ethical tensions between participation and protection are highlighted and discussed in relation to children’s right to privacy, secrecy, and trust. The Swedish context—with its low threshold for mandatory reporting but where parental consent plays a significant role in the possibilities of providing interventions by the social services—is of specific interest to the discussion.

摘要
