Soil Legislation by the European Union: An EU “Soil Monitoring Law” on the Horizon?

This chapter aims at informing about the contents of the proposal on a Soil Monitoring Law and on the discussions and negotiations since its publication, mostly at the European level. As the chapter also addresses a non-European audience, a short overview on the status quo of soils within the European Union and the core challenges are given, followed by a short introduction to the political and legal system of the European Union. Then, the core elements of the EU Soil Monitoring Law are laid down, followed by an in-depth analysis of the proposal by the EU commission and an assessment of its strengths and weaknesses. In the last section, the discussions and negotiations at the EU level amongst the Commission, the Council, and the Parliament from summer 2023 until early June 2025 are outlined. The chapter ends with a summary. The chapter shows that although not all expectations are fulfilled, the EU Soil Monitoring Law is a milestone for working towards the target of healthy soils throughout the European Union.
