Generative AI and the Doctrine of Academic Integrity: A Legal Perspective of Plagiarism, Originality and Liability

This chapter explores the proliferation of generative AI in higher education and the consequences of AI-generated content for academic integrity, in particular, legal implications. With AI tools being used in writing ubiquitous, worries about their part in promoting plagiarism and creative cheating are arising frequently. The chapter focuses on how AI has redefined plagiarism as well as authenticity and exposes opportunities in reshaping learning experiences. Legal points of view are discussed, such as the changing definition of plagiarism, AI’s application in dishonesty, and possible measures to address infringement of academic integrity. Questions related to ownership and authorship of AI created content are raised, as well as, given the situation with the violation of IPR, the issue of the definition of authorship. The chapter focuses on the academic dishonesty prevention and involves educational institutions, professors and students. In case of misusing AI, the chapter pleads for severe legal consequences as well as the application of criminal stigma. There are policy implications which are thrown for the enhancement of the use of AI in order to correspond with ethical learning. The chapter ends by endorsing global legal changes to strengthen academic integrity and ethical standards while establishing a fair environment where AI use in learning achieves its best while not undermining academic values.
