This chapter sets the stage for understansing the susbsequent discussions and arguments in this Handbook by providing a compelling analysis of the problem of environmental protection from a past to present and future perspective. It argues that the underlying problem with global environmental protection as understood today, is largely attributed on the problematic conceptual contour of the right, depsite its firm entrenchment in domestic constitutions, and pronnouncements by the courts.
