GenAI and Proportionality: European and Portuguese Ethical-Legal Framework

Generative AI systems are changing society, the way we relate with each other and the way we perceive time, space, and reality. The research problem we now focus on addresses the still unsettled and yet-to-be-found Human-AI relation keystone. Firstly, how AI systems regulation complies with explainability, transparency and accountability demand as well as with a responsible, educated, conscious, ethical and trustworthy usage. Secondly, how the definition of “high-risk” AI systems may impact Human-AI sustainable development. Thirdly, ponder the proportionality principle framework, within the scope of the EU AI Act and the GDPR, considering special categories of personal data. Although the focus of this research is on Portuguese and European Union ethical-legal framework solutions on all these issues, we have adopted comparative law methodology with the dialogue and contributions from other ethical-legal orders.
