Entitlement to USO Compensation in the Light of the Recent Caselaw in the Transport Sector

The chapter reviews three judgments of the Court of Justice on public service obligations (PSOs) in the passenger transport sector and the rights of operators to receive compensation in return for the discharge of those PSOs. It is argued that the judgments will be relevant not only for the upcoming reform of the Postal Services Directive but also for current situations where the State fails to provide compensation for meeting USO and other “service of general economic interest” (SGEI) costly obligations.
