Medical Malpractice: Analysis of Factors Driving Litigation and Insight into Reducing Risk

Medical malpractice litigation is a topic of great importance for practicing physicians. This chapter introduces the general legal principles of prosecuting a medical malpractice lawsuit against a physician. It is important for physicians to understand the legal standard by which they are judged in the court system. Equally important is the understanding of why patients choose to sue physicians and what types of patients are most likely to sue. Surgeons who practice in the field of urogynecology sometimes face different risks than their counterparts in other specialties. While medical malpractice litigation will never be eliminated, there are tactics that can be used by physicians to greatly reduce the chance of being sued.
