Banking Digitalization and Regulatory Challenges in Personal Data Protection: A Systematic Review

This study examines the regulatory challenges arising from the implementation of Distributed Ledger Technologies (DLT), Blockchain, and Artificial Intelligence (AI) in the banking sector, with a particular focus on personal data protection. While these technologies promise significant advancements in efficiency and security, they also pose critical risks related to privacy, transparency, and trust between users and institutions. Using a qualitative methodology based on the PEO and PRISMA 2020 frameworks, an exhaustive review of studies published between 2019 and 2024 was conducted, selecting 17 key articles that highlight issues such as algorithmic biases, vulnerabilities to cyberattacks, and the inability of these technologies to adequately safeguard big data. As a proposal, fundamental principles for a robust regulatory framework are identified, emphasizing legality, transparency, prevention, technical promotion, and inclusivity within a constantly evolving digital environment. Finally, the study underscores the importance of empirical and comparative research that considers the cultural, economic, and technological specificities of regions such as South America, aiming to foster a more inclusive and contextually adapted regulatory approach.
