In the international context, some countries have chosen to adhere to the Budapest Convention, considered an international legal framework to safeguard legality and due process. In Ecuador, however, not being a party to this convention, the regulation for the offense of child pornography involving the use of children and adolescents is governed by the COIP, well defined in its Articles 103 and 104. Nevertheless, as part of cybercrime, including child pornography, it is important to mention that, just as cybercriminals utilize interconnected technological means in cyberspace to commit unlawful acts and stay at the forefront of technological advances, they also employ Artificial Intelligence (IA) tools to create sexually explicit images of minors. Ecuador has taken a significant legal step regarding special investigation techniques, such as the undercover computer agent. This crucial role is assumed by an individual authorized by the competent authority, typically the Public Prosecutor’s Office, who, while concealing their identity, utilizes their technical expertise to patrol cyberspace and infiltrate computer platforms through hacking and phishing methods. Their objective is to identify suspects, gather information, and compile evidence to ascertain the commission of the offense.
