Intellectual Property and NFT Use in the Metaverse: A Global Approach to Regulation

This chapter offers an introduction to the emerging use of non-fungible tokens (NFTs) in the Metaverse and their implications for intellectual property (IP) rights. It aims to provide new researchers with a clear foundation in this technically complex area, while also challenging traditional IP frameworks, such as copyright and trademark, by questioning the traditional notions of ownership and authorship in decentralised virtual realms. This chapter identifies issues with the disparity between territorial intellectual property rights and the borderless nature of blockchain technologies, the treatment of AI-generated works, and the uncertainty surrounding licensing and enforcement. From the UK and comparative perspectives, the article identifies gaps in regulation and calls for a more harmonised global initiative in law reform.
