The Interplay of Legislation and Judicial Intervention in Safeguarding India’s Forests: A Critical Analysis

Forests, regarded as the lungs of the Earth, play a pivotal role in safeguarding the global environment. India, renowned for its biogeographical diversity, boasts a rich tapestry of flora and fauna. The significance of forests in India extends beyond ecological considerations, intricately weaving into the social, cultural and political fabric of the nation. For some, forests are sacred; for others, they represent a wellspring of exploitable natural resources. The last 15 years have witnessed a dynamic interplay of growth, decline, utilization, and restoration within India’s green expanses. This chapter delves into the nuanced landscape of India’s forests, examining the multifaceted dimensions they occupy in the nation’s collective consciousness. A controversial amendment in the year 2023 to the Forest (Conservation) Act,1980 regulating forest diversion for construction and mining, by excluding the land required for public road and enmities, has recently passed both the Lok Sabha and the Rajya Sabha, sparking concerns among environmentalists, conservationists, and tribal groups. The amendments, by narrowing the Act’s jurisdiction, have raised questions about the future of India’s forests in the face of relentless urbanization, development, and industrialization. This may even go against the Supreme Court rulings on forest conservation. Since the enactment of the Forest Conservation Act in 1980, afforestation efforts and compensatory afforestation have seen a notable increase. However, the new measures proposed under the recent amendments, coupled with the voracious appetite for mining and road development, have posed existential threats to India’s forests. This chapter aims to investigate the legislative setting governing forest protection in India, exploring the implications of recent amendments and assessing the role of the judiciary in upholding environmental integrity. This study proposes to critically examine the effectiveness of existing laws, shedding light on the delicate balance between development imperatives and environmental preservation. By scrutinizing the evolving legal framework and the role of the judiciary in shaping the future of India’s forests, this chapter endeavors to provide insights into the current state of affairs and the potential path of India’s environmental future.
