Unparalleled technological developments have come on the heels of the digital transformation wave, reorganizing societal structures with critical implications for human rights. The chapter discusses opportunities and challenges in the digital transformation process with a focus on enabling human rights and risks to the protection of individuals. Through a qualitative methodology, the study engaged in a literature review to track trends, regulatory frameworks, and case studies, and an analytical approach toward identifying gaps that would lead to actionable insights. Results exposed the duality of digital transformation, where on the one hand technological innovation respects rights and sometimes involuntarily disregards them. The study therefore underlines the imperative need for a proactive legal framework that can align digital developments with the protection of human rights.
