Compensation in Civil Law in the Era of the Digital Economy and Financial Technology
摘要
This research examines the legal framework that governs compensation mechanisms for damages, highlighting their importance in achieving justice and restoring equilibrium for individuals impacted by unlawful actions or specific mistakes. Compensation serves not merely as a financial remedy but also as an essential instrument for preserving social and psychological balance for those harmed. Through an analysis of various laws and judicial decisions, including rulings from Jordanian courts, this study emphasizes the role of compensation in fostering accountability and responsibility within legal frameworks. Additionally, it presents recommendations aimed at enhancing compensation processes, such as the creation of independent monitoring entities, the promotion of suitable insurance coverage, and the establishment of clear criteria for assessing compensation. These initiatives seek to improve the fairness, timeliness, and efficiency of the compensation system, thereby contributing to the advancement of a more just society that diligently protects individual rights and upholds legal integrity.
