A Comparative Study of the Legal Liability for Candid Camera Programs in Digital Content

The manuscript addresses the most relevant legal consequences relating to candid camera programs in digital media. The chapter is, therefore, concerned with the concept of civil liability applicable to such programs and with defining the parameters of such account-ability, evaluating the adequacy of existing civil legal frameworks to address this accountability. Using a descriptive-analytical approach, this chapter will undertake an exploration into the various dimensions of civil liability to cover up the injury caused to people and other side effects which arise from such programs in the society at large. The research thus emphasized that such programs should never have their value for mirth overrun by the harm it could cause to certain people, observing that they could lead to long-lasting psychological and emotional damage. Findings, therefore, reflected that the existing legal framework did not address civil liability in an area where it ought to have been protected. As a result, the chapter proposes that the civil law be amended to clearly spell out the principle of liability for all persons who participated in the creation and diffusion of programs on which their employees base to vindicate the attack. It further proposes increased regulation to ensure that the content creators are held liable for any forms of harm or distress resulting from such programs.
