The Legal Implications of Medical Errors: A Study on Civil Liability in Light of Modern Medical Technologies

This research investigates the legal ramifications associated with medical errors, with a particular emphasis on the civil liability that emerges from such errors in the context of contemporary medical technologies. It assesses how advancements in medical technology influence the accountability of healthcare providers for errors that lead to patient harm. The findings underscore the paramount significance of safeguarding the patient's right to safety and the legal repercussions that arise when medical errors occur as a result of negligence or noncompliance with established medical standards. Employing a descriptive-analytical methodology, the research evaluates the nature of civil liability pertaining to medical errors, indicating that it may arise from either negligence or a contractual obligation, contingent upon the existence of a formal agreement between the physician and the patient. The study concludes by advocating for legislation that explicitly delineates the civil liability of medical professionals within the framework of modern medical practices and technologies, thereby ensuring enhanced protection for patients and providing clearer directives for healthcare providers.
