The OLC issued a second opinion concerning presidential amenability to prosecution. Like the predecessor, the opinion emerged from a presidential scandal in which a special prosecutor considered bringing criminal charges against the President. This chapter analyses the basis of that opinion, confirming the earlier opinion, in light of legal and historical developments since 1973. That opinion too was seriously flawed and this chapter focuses on those flaws.
