Special Counsel Robert Mueller’s investigation found evidence that President Trump had likely obstructed the investigation whether Trump or members of his presidential campaign had illegally aided the Russian interference in the 2016 election in order to benefit the Trump campaign and disadvantage the Clinton campaign. However, Mueller came to the conclusion that opinions of the Office of Legal Counsel in 1973 and in 2000 foreclosed prosecuting Trump while he was in office. As detailed in this chapter, a close reading of both judicial and historical precedent, including the views of the Constitution’s Framers, reveals that the basis of those opinions is fatally flawed.
