Copyright Law and Competition Law: Nature, Characteristics and Objectives

The issue of the copyright-competition interaction generated many discussions in the academic society all around the world. Although this specific issue is not a novelty, no appropriate approach to it has been produced. The reason for this could be that in most of the discussions on this matter, there is often neglect of the fundamental laws that this issue concerns. Namely, the copyright-competition interaction issue inevitably comprises copyright law and competition law, each with its individual development, principles, rationales and regulation. Hence, to demystify the copyright-competition interaction issue, it is in the first place necessary to take into consideration the fundamentals of copyright law and competition law and clearly distinguish the elements of those laws that concern this specific interdisciplinary issue. Only when there is a fundamental understanding of the copyright law and the competition law will it be possible to comprehensively analyse the situations in which they interact and discuss how to approach such situations.
