This chapter aims to chronologically reflect the developments of competition law and policy in Kosovo and the impact that EU legislation has had on this development. Initially, the normative aspect of the competition legislation will be discussed. The normative as well as enforcement parts shall focus mainly on anti-competitive agreements, and abuse of a dominant position. A relevant part of this chapter will be devoted to the enforcement of competition legislation in Kosovo by the Kosovo Competition Authority (the Authority), in original Autoriteti Kosovar i Konkurrences, as a competent institution at the administrative level for the implementation of the competition law as well as the judicial review of competition cases in courts. The chapter will also reflect the recent legal changes in the competition legislation in Kosovo, including private enforcement as this right was not recognised in the two previous competition laws in Kosovo, until the new Competition Law of 2022. The last part of this chapter will focus on the current challenges that follow competition law enforcement as well as future challenges that may continue being present when it comes to effective enforcement of competition law in Kosovo.
