Ethical Boundaries of Workplace Romance: Analysis Through the POSH Act 2013

Research indicates that workplace romance has a significant influence on sexual harassment in organizations. While some of such relations are healthy, others may significantly negatively affect job performance. We had initially developed a conceptual framework that interlinks the attitude towards workplace romance and its perceived influence on sexual harassment. Indian government’s Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 or POSH Act, 2013, currently does not address workplace romance in the workplace. We proposed that the POSH Act awareness decreases the possibility of sexual harassment. We further tested the association between Workplace Romance and job performance (bifurcated as task and contextual performance). We gathered evidence from the Indian healthcare industry (n = 226). Our analysis indicates that attitude towards workplace romance is significantly associated with Task Performance and Contextual performance. Employees who rate themselves high in both Task and Contextual performance increasingly perceive that Workplace Romance is positively related to Sexual Harassment. However, they also hold that the possibility of Sexual Harassment can be reduced when it is moderated by POSH Act awareness. In this paper, we propose that awareness of employees regarding the POSH act would act as a check against sexual harassment, particularly in a romantic relationship in the workplace. The demography of responses was skewed (more female population and higher education level), which might have an implication in the veracity of our conclusion. Our study is the first of its kind in empirically validating the effectiveness of POSH Act awareness in decreasing sexual harassment.
