This work was developed during studies to obtain a Master’s degree at the Brazilian Institute of Education, Development, and Research (IDP) in 2021, under the guidance of Professor Laura Schertel Mendes and received an Honorable Mention as one of the best dissertations in the institution's Master's program in 2022, resulting in the university's Academic Merit Recognition Award. After approval, it was updated in 2023 for publication in book format, named “Era das Neurotecnologias: O papel dos neurodireitos.” This English version aims to demonstrate how the topic can be approached for studies from the perspective of an already consolidated fundamental rights theory, which is the case of the Federal Constitution of Brazil of 1988, as it has more than 30 years of jurisprudential and doctrinal development.
