Negotiation in Resolving Obstacles in Managing Waqf Land: A Preliminary Review

Waqf, an Islamic charitable endowment, has historically played a crucial role in advancing socio-economic welfare, especially in Muslim-majority societies. However, the management of waqf faces significant obstacles, including a weak legal and regulatory framework, limiting its potential to benefit the public in the long term. This article conducts a literature review of the relevant literature that supports the use of Alternative Dispute Resolution (ADR) especially negotiation to resolve waqf land disputes. It delves into the benefits of utilizing negotiation as an ADR method to address waqf-related issues, drawing insights from academic works on waqf management, and dispute resolutions. Furthermore, this article explores the inherent values of negotiation while addressing potential obstacles in resolving waqf land disputes, presenting a compelling case for embracing negotiation as a solution to enhance the sustainability and impact of waqf assets.
