Crisis Prevention and Pre-resolution Measures

Chapter 9, on “Crisis Prevention and Pre-Resolution Measures”, provides an analysis of various aspects which, in the author’s view, fit under this title, namely: the removal of substantive impediments to resolvability; early intervention measures (EIMs) under the BRRD and within the BU; the precautionary recapitalisation framework and its relationship with EIMs; the use of national deposit guarantee schemes (DGSs) in crisis prevention; and the write down and conversion of relevant capital instruments and eligible liabilities which can also be used during a resolution action. The European Commission’ proposals of 2023 on the reform of the so-called Crisis Management and Deposit Insurance (CMDI) framework in relation to specific aspects of the BRRD, the SRMR and the Deposit Guarantee Schemes Directive (DGSD) are also discussed (as appropriate).
