Criminal Liability of Legal Persons Arising from the Use of Autonomous Vehicles: A Comparative Study

Given the ongoing rise in the use of autonomous vehicles and the subsequent accidents that result in harm to both individuals and property, alongside the lack of legislative oversight in this area, it has become essential to assess the liability of individuals, particularly legal entities, for these incidents. This study investigates the responsibility of legal persons regarding traffic accidents caused by autonomous vehicles. It is divided into two sections: the first examines the framework of criminal liability for legal persons, while the second looks into the implications of such liability for these entities. Utilizing a descriptive analytical method combined with a comparative approach, the study uncovers several findings. Notably, lawmakers view the liability of legal persons in these cases as indirect liability, explicitly excluding public legal entities from this responsibility. The study advocates for the establishment of a clear and specific legal framework addressing the liability of legal persons for traffic accidents involving autonomous vehicles.
