Legal Challenges of Protecting Trademarks in E-commerce

This research examines the significance of trademarks and their essential function in differentiating products and services, as well as safeguarding the rights of both traders and consumers, particularly in light of technological progress and the growth of e-commerce. It centers on the idea of the electronic trademark, which serves as a digital commercial identity that bolsters companies’ visibility on websites and social media platforms. Additionally, the study underscores the legal obstacles tied to the protection of these trademarks within the digital realm, where some legal systems encounter numerous challenges regarding the regulation of electronic trademark registration and protection. The objective of this study is to investigate the potential infringements that electronic trademarks might encounter online and to emphasize the necessity of a robust legal framework to protect them, maintain their distinctiveness, and uphold the rights of their owners.
