Sea Level Rise and Human Rights
摘要
Sea level rise, one of the phenomena accompanying climate change, has a negative effect on the enjoyment of human rights. What exactly this effect is, whether and when it entails violations of human rights law, which human rights can get violated, who the victims of such violations are, which States (or other actors) bear the corresponding duties, and what the content of such rights and duties could be, is, however, much less clear and settled. The aim of this paper is to consider these questions. This is mainly done in the second section of the paper. The first section indicates how sea level rise has (or has not) been reflected in international human rights instruments and the case law of international human rights bodies.
