The connection between sustainability and the practice of law has never been clear—but it can no longer be denied that sustainability presents both an opportunity and a challenge for business leaders and their legal advisors that warrants the attention of the legal profession. Sustainability arises most prominently in areas of corporate governance that are not well defined in traditional legal analysis. For example, the role of the corporation to manage its own adverse external impacts on the environment and society, where minimum legal compliance is insufficient to meet the reasonable expectations of critical stakeholders. Some take this characteristic to mean that sustainability is unrelated to law. The author does not believe this is the case and has built a career around integrating an understanding of sustainability practices as part of broader legal expectations or strategic management. In this chapter the author discusses his journey as a sustainability lawyer and shares some thoughts on the evolving relationship between sustainability and law, in theory and in practice.
