Technological Advances in the Legal Framework for Continuous Crimes

This study examines the evolving legal mechanism governing the regulatory framework and penalties for continuing crimes and the role of technological advances in shaping the legal approach, classification, and prosecution and enforcement of continuing crimes. Continuing offenses are defined as offenses based on ongoing criminal activity where the offense is committed as a continuous act or course of conduct rather than as a single act. They often require a sophisticated monitoring and control mechanism due to their persistent nature. In this context, technological advances such as digital surveillance, data analysis and automated reporting systems have a role to play in effectively combating and prosecuting continuous crime. The study will demonstrate the legal framework governing the regulatory system and penalties imposed for such crimes, the role of technology and how technological tools are used to locate, track and identify criminals and crimes. The implications for the criminal regime and legal procedure, and more specifically how these technologies offer better ways of dealing with ongoing crime, will be discussed next.
