Technological Impact on the Evolution of Sentencing Practices in the Criminal Justice System: A Critical Analysis of Recent Legal Changes

This study focuses on recent changes in the criminal justice system's approach to sentencing practices—changes that are partly related to legal reforms in sentencing and partly to the increasing impact of technology on the criminal justice system. As a country, we have not always offered so many excuses and justifications for reducing sentences. Factors such as youth, maturity and sincerity used to be the basis for a reduced sentence, but even this has changed. If the family or victim of a sexual offense against a minor or disabled person decides not to pursue criminal proceedings, the sentence is generally no longer carried out. The penalty for the same type of crime is more severe and less forgiving when the perpetrator is a repeat offender, when the crime has been committed of a specific type depending on nationality and place of residence, and when fewer crimes are considered “less serious” much less likely. In this study, I will argue that these recent legal developments are closely linked to technological developments and the increasing role of digital tools and data analytics in judicial decisions and enforcement mechanisms. My goal is to highlight the dynamics of these legal changes and their causes, with particular emphasis on the impact these changes have on the criminal justice system as a whole.
