Criminal Liability of Partners in Cybercrimes: An Analytical Study of Legislation, Legal Challenges, and Technological Developments

This chapter represents the partners’ criminal liability in cybercrimes under criminal law. The goal is to examine technological rules that determine the liability of partners and the resulting punishment and to consider whether such penalties are proportionate or not. Additionally, this chapter discusses how technological evolution has influenced establishing and proving the liability of partners in cybercrimes; it also identifies challenges and possible solutions. The research used an analytical methodology through scrutinizing legal texts and prominent judicial precedents. Results showed an indeterminate specification with partner liability in cybercrimes and that current penalties are not commensurate with the gravity of their impact. Moreover, technological evolution plays a big part in the determination and proof of a stakeholder’s accountability in cyber offenses. This further underlines the need for statutory reforms to keep up with these advancements and variations within patterns of cybercrime.
