The Concept of Criminal Harmfulness
摘要
In this chapter, the research confronts the attempt of criminal protection of the economic order against the concept of criminal harmfulness, that is, the offensiveness that is required present in each incrimination. Thus, passing through the classical view of the concept of harmfulness as a necessary element to the finding of offense or serious threat of offense to a legal good of dear social interest, until its apprehension as revealing a transgression to the order, or injury of duty, its occurrence or not in economic criminal typification will be verified. This reveals itself as an essential element for the reflection of the necessity or not of criminal intervention in a specific branch of human activity.
