This chapter examines the policy and regulatory challenges of artificial intelligence (AI) from the perspective of the typical lifecycle of an AI-powered product, taking into account previous incidents of AI bias. It explores how the legal consequences of AI bias can be controlled in the case of both explainable and non-explainable algorithms. In this regard, the chapter analyses developments in EU policy, in particular those that aim to create a comprehensive policy response suitable for an ‘algorithmic society’. It highlights that European policy-making faces difficult choices as on the one hand it needs to create sufficient controls for AI-risks, while on the other it needs to guarantee the competitiveness of European industry and societies.
