AIPD is not always undesirable from an economic perspective: whether it amounts to an abuse of dominance in competition law requires competition authorities to make a tradeoff between different considerations such as efficiency and justice. As discussed in previous chapters, competition law alone cannot fully address concerns caused by anti-competitive and welfare-reducing AIPD, as it is primarily an ex-post mechanism. Rules beyond competition law can also address concerns caused by welfare-reducing AIPD ex-ante through data governance, consumer protection, and business regulation. This chapter provides policy recommendations for China and the EU to effectively address anti-competitive and welfare-reducing AIPD, with an emphasis on ensuring consistent and predictable enforcement of AIPD-related rules.
