Cybersecurity and Global Data Protection Laws: Post-gDPR Era Analysis

Privacy is a fundamental right and has various meanings, and its importance differs greatly among people depending upon their affiliation. It can be construed as a basic freedom and human rights and is deeply connected with digital technology. Due to the rapidly changing world of technology and its advancements in information and communication, the use of electronic media and the collection and storage of huge personal data has led to various legal and ethical issues such as privacy and censorship. The current research addresses the present cyber security challenges and has attempted to outline the cyber-attacks in organizations and the challenges for organizations and an overview of Cloud Computing implications on the right to privacy and the laws governing the United States of America. The study's methodology is entirely doctrinal to offer a deeper understanding of the inner workings of privacy law and its foundation of the General Data Protection Regulation. The information acquired during this research demonstrates the significance and the implementation of privacy laws and data protection regulations, all in all, the outcome of privacy and data protection and privacy laws is determined by the conduct of those charged with enforcing the law, not by the content of the legislation. The information on privacy rules that control the United States private sector was enacted in response to specific cases of abuse, perceived systemic failure, or the involvement of highly confidential data. There is fear that information privacy concerns vary so widely across industrial sectors that a “one size fits all” regulatory approach would have little accuracy needed to avoid meddling with the benefits of an open flow of information.
