This study aims to highlight the importance of AI systems in contemporary reality and identify the characteristics that influence their legal regulation. It seeks to classify the types of civil liability arising from the damages caused by AI applications and assess the possibility of establishing a precise legal foundation for this liability. Thus, addressing the evolution in legal responsibility concerning AI applications, specifically in terms of civil liability for damages resulting from the unlawful use of AI. This prompts an investigation into whether the general principles of civil liability, both contractual and tortious, as enshrined in most contemporary civil laws, are adequate to address damages caused by AI systems. Are classical liability rules capable of effectively managing this new form of liability, or is it time for a new legal foundation that aligns with the changes AI introduces to the civil legal system? Additionally, can this modern legal foundation succeed if adopted, and what are the prerequisites for its success.
