This chapter focuses on the enforcement measures restricting the freedom of mentally ill offenders in Italy. The reflections stem from a study which analysed spaces and relationships among staff and inmates within the facilities where these offenders are restricted. We reflect on the social construction of dangerousness applied to this specific context: adopting a socio-legal approach, the empirical data (mainly interviews and focus group involving health staff) are investigated through the lens of actuarial justice, shifting the focus from individuals to groups considered at risk. We suggest that the selective incapacitation of dangerous groups ends up marginalising even more of them putting in place the transition from one penal control institution to another.
