This chapter intends to give a brief introduction to the legal regime for carbon capture, transportation and storage (“CCS”) on the Norwegian Continental Shelf. It intends to address in brief the requirements for being eligible for being granted a CCS licence, the form of cooperation required of the participants and its legal documents, hereunder the corporate arrangement to be established. The legal framework for CCS activities is based on the framework well known from the petroleum industry. The interested parties will apply for a concession and will, if granted, enter into a standard Agreement for Storage Activities that regulates the cooperation between the parties. The cooperation between the parties is organised as a general partnership in accordance with the Companies Act. The legal framework for CCS activities and the Companies Act is not aligned and changes to the corporate documentation are therefore required. These changes are implemented in the Partnership Agreement, which for all practical purposes makes the Government-issued legal framework for CCS activities the ruling framework for the operations.
