The topic of this chapter is regulatory competition between the EU and its Member States regarding AI. First, I will briefly discuss direct regulation, particularly the AI Act, and then go on to liability law: strict liability as a classic instrument for technology regulation, product liability under the new Product Liability Regulation, and fault-based liability under the national law. Finally, I will touch upon the relationship between safety law (direct regulation) and liability law (indirect regulation) concerning duties of care.
