摘要

This chapter begins the analysis of existing substantive protections deriving from international human rights frameworks and their efficacy in safeguarding the rights of children in street situations which culminate in Chapter Five . This section examines the Convention on the Rights of the Child (CRC), focusing on provisions that address both the root causes leading children to street situations and the subsequent challenges they face. The chapter also critically evaluates the CRC in conjunction with General Comment No. 21 (2017), which specifically targets children in street situations, assessing its role in bolstering protective rights within the CRC framework. Moreover, it extends its scrutiny to other pertinent General Comments from the CRC Committee and the three Optional Protocols to the CRC, evaluating their relevance to the unique circumstances of children in street situations. The chapter also underscores the significance of the Concluding Observations issued by the CRC Committee, providing a holistic view of the international legal landscape concerning children in street situations.
