Future generations have made their entry into constitutional jurisprudence. Their constitutional protection does not depend on the simple declamation of intergenerational claims. It depends on a number of factors, including the ability to apprehend the issue not just in terms of procedures but as a process, the capacity to reintegrate the long term into public action, and the constitutional judge’s ability to assess a reasoned relationship to risk.
