Climate Change and the Rights of Future Generations: The Contribution of Courts

The chapter discusses the constitutional foundations of the rights of future generations by engaging critically with judicial decisions that have recognized climate-based claims as justiciable. To this end, the text surveys the findings of courts within and outside Europe, to discuss the emergence of a supranational trend in the recognition of personal or group entitlements to a sustainable development of the planet, to the protection of the environment from intensive exploitation and to the prevention of catastrophic changes to global climate.
