Centralization of Responsibilities for the Screening of Foreign Direct Investments in the European Union and its Member States

This paper argues that the current state of delineation of responsibilities in the field of foreign direct investment (FDI) screening in the European Union as developed by the Screening Regulation should be overhauled. In order to enable the European Union to speak with one voice on this sensitive issue and to streamline the process for investors from states outside the European Union, the role of the European Commission should be strengthened. In some scenarios, the Commission should be able to make the final and binding decision on measures taken against the investment in question.
